When an infant brings a lawsuit through his or her parent or guardian and the case is going to be settled, the court has special requirements. An Infant Compromise Order must be submitted to the court for signing. The judge must meet the injured child in person with the parent or guardian before signing off on the settlement. The settlement of the child’s case must be approved by the court. The child’s parent or guardian cannot settle the case for them without the court’s approval. It is for the protection of the child.
